Court Fixes June 10 for Hearing in Tinubu Estate Land Dispute Against Lagos State Government

Date:

Justice Oyindamola Ogala of the Lagos High Court in Ikeja has scheduled June 10, 2025, for the hearing of a preliminary objection in a land dispute suit filed by the estate of the late Efunroye Tinubu against the Lagos State Government and several of its agencies.

During Tuesday’s proceedings, the judge directed that the preliminary objection be served on all parties in the case, with proof of service to be filed before the next hearing.

The suit, filed by Tinubu Estate and Works Limited, challenges the Lagos State Government, the Attorney General, the Commissioner for Physical Planning, the Permanent Secretary, the Lagos State Property Development Corporation (LSPDC), and other enforcement agencies over their alleged refusal to perfect ownership documentation for a large parcel of land registered as No. 45 on Page 45 in Volume 2212 of the Lagos State Land Registry.

The estate claims that a government directive — “No Transaction, No Certified True Copy” — placed on the land title constitutes an unlawful reversal of their long-standing ownership without due legal process. They argue that ownership was affirmed by the Federal Supreme Court in 1912 and further validated by a 1954 Petition of Right.

According to the claimants, suspending operations on the land and marking buildings for demolition without notice or a hearing infringes on their constitutional rights. They contend that summoning estate beneficiaries for questioning and issuing directives that could lead to property confiscation is an attempt to undermine existing court judgments.

The estate is asking the court to declare the government’s actions unlawful and to restrain state agencies from interfering in the matter or continuing related prosecutions.
